If a foreign state requests the extradition of a fugitive accused or criminal to the Government of Nepal, the Government of Nepal may extradite such accused or criminal to such state subject to this Act under the following circumstances:-

(a) There is an extradition treaty,

(b) There is an extraditable offense under section 4.
